151023 rsGrafton – Grafton officials and residents were disappointed to learn that their request to have a judicial review of a federal Surface Transportation Board ruling (STB) was denied. The request had been made after the STB’s declaratory order that the Grafton & Upton Railroad liquid propane transfer terminal in North Grafton was pre-empted by state and local laws.

The decision is the latest in a dispute between developer Jon Delli Priscoli, who bought the railroad in 2012 and the town. Officials contend that the terminal, to be built at 42 Westborough Rd., was too close to a neighborhood, school and public water supply. But in September 2014, the STB overrode those concerns and ruled that Delli Priscoli could proceed with the project.

Grafton has already spent over $100,000 trying to block the terminal. The latest decision also requires that they pay unspecified court costs to the federal agency and the railroad.
